Colorado water rights are a person’s or entity’s right to use the waters of Colorado. They are based on the Colorado Doctrine of prior appropriation, which determines water rights according to the priority of a party's acquisition of a certain amount of water, in a certain place, for certain uses.
Water in Colorado is treated as a private property right that is bought and sold and can be separated from the land upon which it is or has been used. The owner can lease or sell the rights to others, apart from the rights to the land. Water right transactions must be properly investigated and documented to preserve the value of the water right and if changes are necessary, Water Court approval is needed.
